What is asylum? The legal basis

Protection as a refugee

refugee familyThe legal basis of the protection given to refugees in the United Kingdom is the 1951 Convention Relating to the status of refugees read with the 1967 Protocol (‘the Refugee Convention’). In order to be granted protection as a refugee, individuals have to show that they have a well-founded fear of persecution on account of their race, religion, nationality, political opinion or membership of a particular social group. The acts of persecution or feared persecution must be committed by the state or by groups or individuals, which the state either cannot or will not control.

Where and how applications for asylum are made

Applications for asylum can be made at a number of places:

  • On arrival in the UK at the air or sea port
  • After arrival in the UK
  • After arrest or detection as an illegal entrant or over-stayer
